Bivwak cannot be held liable for any losses or damages incurred by using our website and any of our services. Please know your responsibilities because you will be held accountable for your actions. We retain the ability to amend the Terms and Conditions within this page at any time. All amended terms will be effective immediately so please check the Terms and Conditions link located at the bottom of every page for any updates and amendments. Rights To Suspend or Terminate. You agree that Bivwak, in its own discretion, may terminate any auction or use of the service immediately and without notice if (a) We believe that you are not abiding by the general rules of Bivwak (b) You have repeatedly broken a certain term (c) You have listed a suspicious item (d) We believe you to be a non paying bidder. In most cases when we suspect foul play we will suspend your account/listing whilst we investigate further. If our investigation is conclusive then your account with us will be terminated. Items And Auctions That Are Prohibited. -Adult and pornographic material (including any nudity, this includes your listing photos as well) -Alcoholic beverages or any items containing alcohol -Animals or pets (This includes any living or dead animal, bird, mammal, person, etc...) -Historical artifacts (Not only is there potential legal ramifications to this but it doesn't really have anything to do with the outdoors) -Certain articles of used clothing (no used underwear, it's just gross and we don't want to see it) -Counterfeit or fake items of any kind (whether it's currency or a designer purse, if it was made to deceive the buyer we will remove the listing and possibly ban your account) That being said, Bivwak can not be held accountable for fake items being bought or sold on Bivwak.com, the actual seller assumes all responsibility for the listing. Please know what you are buying before bidding. -Drugs or items pertaining to drug use (this includes water tobacco pipes or any like items) -Body parts of any kind from anything or anyone -Any item or service that encourages illegal activity -Deliberately Offensive Material -Recalled Merchandise or items -Any Property with removed serial numbers -Anything that has at one time been acquired illegally While Bivwak constantly monitors what is listed, we will not be held responsible for any seller's listing and expect the buyer to know their local laws and regulations on all items they intend to purchase. For some items these laws change for every state, county, and/or city. Your Conduct. You are solely responsible for the contents of your actions through Bivwak. You must ensure that your participation in the selling or buying of items does not violate any applicable laws or regulations. By this we mean that you must check that you are entitled to sell or buy the relevant item and that you are not prohibited from doing so by any law or regulation. You must not transmit through the service any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material. You must also not transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable law or regulation. You also agree not to list items inappropriately, we will place it in the appropriate category the first time it happens but reserve the right to suspend or terminate if it continues to happen. If you break any laws or are not able to enter into a legally binding contract, your account will be deleted immediately and all your auctions will be canceled. Our first priority is giving our members a safe community to buy and sell products without the risk of fraud and if you are becoming a risk, you will be banned. Membership. Membership to Bivwak is only available to those who can form a legally binding contract. Bivwak does not permit minors (under 18) to register. If any member fails to sign up with their correct age the account will be terminated immediately. If you have a dispute with one or more Bivwak members, we will help any way possible but by agreeing to these terms you release us from any damages, claims and lawsuits in any way, shape or form. You also hold us harmless from and indemnify us from any claims and/or demands including any fees that may arise. General Terms. Bivwak acts as the window for sellers to conduct auctions and for bidders to bid on sellers' auctions. We are not involved in the actual transaction between buyers and sellers. As a result, we have no control over the quality, safety or legality of the items listed, the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to buy items. We cannot and do not control whether or not sellers will complete the sale of items they offer or buyers will complete the purchases of items they have bid on. In addition, note that there are risks of dealing with foreign nationals, underage persons or people acting under false presence. Bivwak shall not be responsible for any items sold by Auction, for any damage to items during transit or during the inspection period, nor for misrepresentations and/or breaches of contract by either buyer and/or seller. Bivwak shall not be responsible for the cost of procurement of substitute goods or any losses resulting form any goods purchased or obtained. Bivwak assumes no liability for the content of the listings. However, if you fall victim of a fraudulent transaction, we will assist you as much as we can.
